A Question of New Construction Warranty
It is not uncommon that I hear from people who have had a bad experience with a builder regarding new construction of either a condominium or single family home. Many times they will complain about the quality of work, things left undone or how long beyond the scheduled completion date the project went. I’ve heard horror stories of things that have gone wrong and simple repairs not fixed correctly or in a timely manner, leading to larger repairs. People will often ask what their options are regarding a builder’s home warranty and what constitutes repairs done correctly.
Because of the competent job that many title companies do in closing sales here in the state of Florida, law offices here are not used as frequently as they may be in the northern states. I used a lawyer in conjunction with every real estate closing that I had, when I lived in New England and things always went smoothly. Again, here in Florida it is quite different.
In the case of new construction, my suggestion is that you retain the services of a competent attorney. If you do, you will not be at the mercy and dealing directly with the builder, who may or may not have be interested in satisfying your complaint. With a good lawyer, you will have strong representation when it comes warranty work on your new home, and he or she will definitely have your interests in mind. It may cost you a bit more, but in the long run, it is well worth it for piece of mind.
