ARE THERE GHOSTS IN THIS HOME?
Sometimes we have a customers ask you about whether we have to disclose material facts about a property? What happens if someone has died violently and we know about it, must that be disclosed?
There is a Florida Statute Title XL Real Personal Property Chapter 689 Conveyances of Land and Declarations of Trust that addresses this very issue and others. It is quite specific in 689.25 about property that was inhabited by an HIV infected person, but with regard to other issues there seems to be a lot of grey areas.
Since the statute doesn’t seem to be too difinitive with respect to murder, suicide or the like, probably the best policy is to Disclose…Disclose…Disclose. After all we sure would want to know of any strange happenings in the property that we were considering purchasing!
